Nikki’s Cuisine LLC (“Nikki’s Cuisine,” “we,” “us,” or “our”) runs the website https://nikkiscuisinellc.com (the “Site”). This Privacy Policy explains what personal information we collect when you visit the Site, place an order, pick up or receive an order, text or email us, message us on Facebook or Instagram, or sign up for our messages. It also explains how we use and share that information, and the choices you have.

This policy is part of our Terms of Use.

1. Information We Collect

a) Information you give us

  • Contact details: your name, email address and phone number.
  • Order details: the items you order, your pickup or delivery date and time, delivery or shipping address, billing address, order notes, gift messages, and cake inscriptions or design requests (including any photos you send us).
  • Messages: what you send us by text message, email, web form, or social media (including Facebook Messenger and Instagram direct messages), and our replies.
  • Reviews and submissions: reviews, comments, photos and survey or contest entries that you choose to submit.

b) Information collected automatically

When you use the Site, we and our service providers automatically collect:

  • your IP address, browser and device type;
  • the pages you view, how long you spend on them, and the website or link that brought you to us;
  • your approximate location, based on your IP address; and
  • cookie and similar technology data (see Section 4).

c) Information from others

  • Payment providers send us confirmation that a payment went through, the payment method type, and the last four digits of your card. We never receive or store your full card number.
  • Delivery and shipping carriers send us delivery status updates.
  • Fraud-prevention services send us a risk assessment of a transaction.
  • Meta (Facebook and Instagram): when you message our Facebook Page or our Instagram account, Meta gives us your name or username, an ID that Meta assigns to you for our Page or account, and the messages, photos and other files you send in that conversation. We don’t receive your password, and we don’t access your friends, followers or posts.

We do not ask for sensitive information such as health information, government ID numbers, or financial account numbers. Please don’t send us any. If you tell us about a food allergy or a dietary need so we can handle your order, we use that information only to handle that order.

2. How We Use Your Information

We use personal information to:

  1. Fulfill orders: take and confirm orders, process payments, prepare your food, and arrange pickup, courier delivery, or shipping.
  2. Communicate with you about your orders: send confirmations, reminders, pickup notices and delivery updates, and answer your questions.
  3. Send marketing messages, but only if you’ve agreed to receive them: menus, cook-schedule announcements, promotions and holiday ordering reminders (see Sections 6 and 7).
  4. Run and improve our business: understand what’s popular, plan our cook schedule, and improve the Site, our menu and our service.
  5. Protect you and us: prevent fraud and misuse, secure the Site, and enforce our Terms of Use and Refund Policy.
  6. Meet legal obligations: tax, accounting and record-keeping requirements, and responding to lawful requests.

3. How We Share Your Information

We do not sell your personal information, and we do not share it with anyone for their own marketing.

Our service providers may use your information only to provide their services to us.

4. Cookies and Analytics

We use cookies and similar technologies to:

  • keep your cart and checkout working (these are essential);
  • remember your preferences;
  • understand how visitors find and use the Site, through analytics tools such as Google Analytics and our store’s order-attribution feature; and
  • protect the Site from bots and fraud, for example with Google reCAPTCHA.

We do not currently use advertising cookies or ad-tracking pixels. If we start using them, we’ll update this policy first.

Your choices:

  • You can block or delete cookies in your browser settings. If you block essential cookies, the cart and checkout won’t work.
  • You can opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout.
  • Do Not Track: there’s no common industry standard for browser “Do Not Track” signals, so the Site doesn’t currently respond to them.

5. Customer Reviews and Photos

If you post a review or comment, your name, or the display name you choose, and your content will be public. We may share reviews and customer photos that were posted publicly or sent to us with permission on the Site and on our social media. You can ask us to remove your content at any time (see Section 11).

6. Email Marketing

We’ll send you marketing emails only if you sign up for them, for example on our Subscribe page. Every marketing email includes an unsubscribe link. You can also email us to opt out.

Even after you opt out, we’ll still email you about your orders, for example confirmations and receipts.

7. Text Messages (SMS), Messenger and Instagram

Order messages. When you place an order and give us your phone number, we may text you about that order: confirmations, pickup and delivery updates, and replies to your questions.

Marketing messages, only with your consent. You’ll get marketing texts (menus, cook-schedule announcements, promotions and holiday reminders) only if you opt in by ticking the consent box on our Subscribe page. You don’t have to agree to marketing texts to buy from us.

  • Message frequency varies. Message and data rates may apply.
  • To opt out, reply STOP at any time. You’ll get one final message confirming that you’ve been unsubscribed.
  • For help, reply HELP, or contact support@nikkiscuisinellc.com or 347-333-3499.
  • Carriers are not liable for messages that are delayed or not delivered.

Your mobile information is not shared with third parties or affiliates for their marketing or promotional purposes. We share text messaging opt-in data and consent only with the SMS platform that sends our messages, and never with anyone else.

Facebook Messenger and Instagram messages. When you message our Facebook Page or Instagram account, we use what Meta gives us (see Section 1c) only to answer you and handle your order or request. We reply only to messages you send us, and only within the time Meta allows. We don’t send marketing messages on Messenger or Instagram. We don’t sell information we receive from Meta, and we don’t use it for advertising. To stop hearing from us there, stop messaging us, or block our Page or account in the app. Messenger and Instagram don’t have a STOP keyword, and replying STOP there won’t unsubscribe your phone number from our text messages.

8. Automated and AI-Assisted Replies

Some of our replies to text messages, Facebook Messenger and Instagram messages, and other inquiries may be written or assisted by an automated system that uses artificial intelligence, and a member of our team oversees it. Messages you send us may be processed by our AI service providers, but only to help us respond to you. Those providers are not allowed to use your messages for their own purposes. If you’d like to reach a person, just say so, and a team member will follow up with you.

9. How Long We Keep Information

  • Order and payment records: kept for 7 years, to meet tax and accounting requirements.
  • Messages and customer-service records, including Facebook Messenger and Instagram conversations: kept as long as we need them to support you, and then deleted.
  • Marketing lists: kept until you unsubscribe. After that, we keep only a record of your opt-out so we don’t contact you again.

When we no longer need information, we delete it or remove anything that identifies you.

10. How We Protect Information

We use reasonable administrative, technical and physical safeguards appropriate to a small business. These include encrypted (HTTPS) connections, PCI-compliant payment processors, access limited to people who need it to do their job, and regular software updates. No system is perfectly secure. If a security breach affects your personal information, we’ll notify you as required by law.

11. Your Choices and Rights

You can ask us to:

  • see the personal information we hold about you;
  • correct information that’s wrong;
  • delete your information, except records we’re legally required to keep, such as order and tax records; and
  • stop sending you marketing messages.

To make a request, email support@nikkiscuisinellc.com with the subject line “Privacy Request”. Include the name, email address and phone number you used with us. We may need to confirm your identity before acting on the request. We’ll respond within 45 days. Depending on the state where you live, you may have additional rights under that state’s law, and we’ll honor them as that law requires. We won’t treat you differently for exercising your rights.

Deleting information we received through Facebook or Instagram. To have us delete the information we hold from your Messenger or Instagram conversations with us, send a Privacy Request as described above and tell us the name or username you messaged us from. We’ll delete it, except anything that is part of an order record we’re legally required to keep, and confirm by email when it’s done. Deleting a conversation in your own Messenger or Instagram app removes it only from your app; it doesn’t delete our copy.

12. Children’s Privacy

The Site is intended for adults. We don’t knowingly collect personal information from children under 13. If you believe a child has given us personal information, please contact us and we’ll delete it.

13. Links to Other Sites

The Site links to other sites, such as our social media pages, payment providers and review platforms. Their privacy practices are governed by their own policies, not this one.

14. Changes to This Policy

We may update this policy from time to time. We’ll post the updated version on this page and change the “Last Updated” date. If we make a material change to how we use personal information, we’ll give more prominent notice before the change takes effect.
